Selecting a family or divorce attorney in Santa Barbara or San Luis Obispo is an important decision.  Please feel free to read about some general family law information below and do not hesitate to contact us if we can help you with your family  law or divorce matter.   


California is a community property state, which means most property acquired during the course of the marriage is presumed to be jointly owned, and therefore, is subject to 50/50 division.  There are exceptions, such as property that was acquired separately through gift or inheritance.  The doctrine of community property is predicated on the rationale that assets that were acquired during the establishment of the family unit should be credited to the existence of that unit, and partitioned accordingly.   


To initiate a divorce in Central California, you may want to retain a divorce attorney, who would guide you through the following process. Initially, one party (the "Petitioner") must serve the other (the "Respondent") with a petition.  The Respondent then has 30 days to respond, otherwise the process will continue without his or her involvement.  Assuming a failure to respond, the Petitioner would then continue the process by proposing a court order concerning child custody, child support, visitation, spousal support, and division of property.. 

If the Respondent does file a timely response, then a process known as "Discovery" begins, whereby each party exchanges information including financial statements.  At the conclusion of Discovery, either side has the opportunity to file motions regarding any time sensitive issues that must be addressed prior to trial, such as child support, child visitation, and spousal support.  

After the completion of Discovery, the case will be set for trial.  Prior to the trial date, both parties will meet at a mandatory settlement conference, where they will discuss any outstanding issues.  If the parties reach an agreement at that time, then a marital settlement agreement is drafted and the divorce in California becomes final after the waiting period, which is 6 months and 1 day after the petition was initially filed.  If trial is required then a judge will resolve any outstanding issues and the divorce becomes final after the required waiting period.  

Should facts change or new information become available to either party, issues such as child custody, child visitation, child support and spousal support may be reexamined.  The child support calculator, below, may be helpful in determining if a modification may be appropriate. 



We can assist you in obtaining a restraining order or defending yourself against one in Santa Barbara or San Luis Obispo.  The types of restraining orders, generally, are outlined below. 

1.  EMERGENCY PROTECTIVE ORDER (EPO) -  This restraining order is filed by law enforcement and is valid for 5 days.  Useful for domestic violence victims. 

2.  DOMESTIC VIOLENCE TEMPORARY RESTRAINING ORDER (TRO) - This civil restraining order is temporary for 3 weeks and can be made permanent for 1-3 years.  Useful for domestic violence victims. 

3.  CRIMINAL PROTECTIVE ORDER ("NO CONTACT" ORDER) - This restraining order is obtained through the District Attorney's Office and is issued in active domestic violence criminal cases. 

4.  CIVIL HARASSMENT RESTRAINING ORDER (CHO) - This restraining order is a civil order and is used for stopping harassment, annoyances by neighbors, roommates, or co-workers.
